Online Store - Terms of Use


PLEASE READ THIS ONLINE STORE TERMS OF SERVICE (“TERMS”) CAREFULLY. BY ACCESSING, USING OR MAKING A PURCHASE ON THE STARBUCKS SINGAPORE ONLINE STORE (“ONLINE STORE”), YOU HEREBY AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THE ONLINE STORE.


1. General

1.1. These Terms govern your use and access of the Online Store on www.starbucks.com.sg (“Starbucks Website”), the Starbucks Singapore Mobile Application (“Mobile App”), or on any other website or platform on which the Online Store may be available.


1.2. In these Terms, "Starbucks" or "we" or "us" means Starbucks Coffee Singapore Pte. Ltd. and the "customer" or "you" means any person, firm, company or body which places an order with us for beverages, foods, merchandise, seasonal goods, Starbucks Cards, Starbucks Cards eGift, Starbucks Food & Drinks eGifts, vouchers, or other such products as may be made available for purchase on the Online Store from time to time (collectively, “Products”). 


1.3. These Terms supplement and are intended to be read with the Mobile App Terms of Use, the Starbucks Rewards Program Terms of Use, the Starbucks Card Account Terms of Use and Agreement, and our Privacy Policy which you agree to be bound to without restriction. 


1.4. Nothing contained in these Terms is intended to modify any other terms or written agreements you may have with Starbucks that may be in effect. 


2. Minors

2.1. You hereby acknowledge and agree that you are at least 18 years old and are fully able to understand, agree to and abide by these Terms. If you are between the ages of 13 and 18, you may only use our Online Store under the supervision of a parent or legal guardian who agrees to be bound by these Terms. If your parent or legal guardian does not agree to these Terms, you must discontinue using and/or accessing the Online Store.


3. Products, Prices, and Availability


3.1. While we shall make every reasonable effort to ensure that the prices, details, sizes, appearance and packaging of the Products on our Online Store are accurate and up-to-date, there may be instances where errors may occur, and to the extent permitted under applicable law, Starbucks shall bear no liability to you or any third party arising out of such errors. The images of the Products on the Online Store are for illustrative purposes only, and we cannot guarantee that your computer or device’s display of the colours accurately reflect the colour of the Products or its packaging. As such, your Product and its packaging may vary slightly from its corresponding image. 


3.2. Prices of Products on the Online Store are subject to change without prior notice. Save to the extent that we are fraudulent or grossly negligent, we are under no obligation to fulfil your order and reserve the right to cancel your order in the event that the price listed on the Online Store is incorrect (even after your order has been acknowledged or confirmed by us). We will not be liable to you for any losses caused as a result of any price inaccuracies caused by unauthorised access to price data by a third party.


3.3. Prices for Products listed on the Online Store do not include shipping charges. Depending on the mode of shipping selected by you, shipping charges may also be payable on your order and these will be added to the price of your order prior to you submitting payment to us. For details of our shipping charges please see the Delivery section in these Terms.


3.4. We shall also make every effort to ensure that the Products displayed at our Online Store are in stock. If any Products are out of stock, we will not process your order for that Product. We may notify you once that Product is in stock if it has been added to your Wishlist on your registered account.

 

3.5. If your order has been acknowledged or confirmed by us and the Product is subsequently out of stock or otherwise unavailable, we reserve the right to cancel your order of that Product and we will refund you with an amount equal to the amount that has been charged for that Product. 


3.6. The foregoing notwithstanding, we reserve the right to stop the operation or provision of the Online Store at any time and for any reason.


4. Purchase of Products and use of Starbucks Benefits 


4.1. To place an order for a Product on the Online Store, you must either log-in using a guest account or log-in to a registered account as a Starbucks® Rewards Member, which you can sign-up for on the Starbucks Website or Mobile App. 


4.2. Where you make a purchase on the Online Store through a registered account with us as a Starbucks® Rewards Member:


(a) You may use a registered Starbucks Card eGift, “Stars” under the Starbucks® Rewards Program, any benefit / reward on your registered Starbucks Card or such other applicable benefit / reward to (i) redeem Products on the Online Store or to (ii) deduct from the purchase price of Products on the Online Store, as may be applicable; and 


(b) Save for the purchase of a Starbucks Card eGift, you may earn “Stars” under the Starbucks® Rewards program when you purchase any Product on the Online Store. Such “Stars” will only be issued to you where the product is (i) successfully paid for, and (ii) purchased using your registered Starbucks Card. For merchandise purchased on the Online Store, “Stars” will be issued within 48 hours after you click the “Order Received” button, confirming that the merchandise you purchased has been received in good condition. If you do not click on the “Order Received” button, “Stars” will not be issued to you until the 16th day after the date the merchandise is delivered to you. If you choose to return any the merchandise you have purchased before you click the “Order Received” button, you will only be issued “Stars” for merchandise not returned (if any) after the return request has been approved and successfully processed. Please refer to the Starbucks Online Store Return Policy for more information on the terms, conditions and policies that apply to the return of any Product purchased on the Online Store.


4.3. Where you log-in using a guest account: 


(a) You will not earn any “Stars” and/or other benefits / rewards (as may be applicable) where you purchase Products on the Online Store;


(b) You will not be permitted to redeem or utilise Starbucks Card eGift, which for the avoidance of doubt, can only be used if you log-in to your registered account as a Starbucks® Rewards Member.


4.4. The purchase of Products on the Online Store is at all times subject to availability.


4.5. Please refer to the Starbucks Card Account Terms of Use and Agreement and the Starbucks Reward Program Terms of Use for more information on the terms, conditions and policies that apply to Starbucks® Rewards Members, Starbucks Cards and the Starbucks® Rewards program.


5. Placement of Orders


5.1. Our Online Store only accepts orders for delivery in Singapore to a specified delivery address.


5.2. Please take the time to read and check your order at each page of the order process. By clicking the “Add to Cart” button, you agree to purchase our Products in accordance with these Terms and you confirm that the order information (including delivery details and payment details) provided by you are valid and correct, and that when your order is acknowledged and processed by us, payment will be made in full. We will not be responsible or liable for items which go missing or are delayed due to inaccurate or incomplete delivery address or other information provided by you when submitting your order. 


5.3. When you submit an order on the Online Store, you are only offering to purchase our Products. After receiving your order, we will acknowledge receipt of your order. However, this is not an acceptance of your order. 


5.4. ACCEPTANCE BY US OF ANY PAYMENT MADE BY YOU IN CONNECTION WITH ANY PRODUCT DOES NOT CONSTITUTE OUR ACCEPTANCE OF YOUR ORDER AND A LEGALLY BINDING SALE AND PURCHASE AGREEMENT IS NOT FORMED UNTIL AND UNLESS YOU RECEIVE AN ORDER CONFIRMATION AND WE WILL NOT BE OBLIGED TO SUPPLY PRODUCTS TO YOU UNTIL THEN.


5.5. If your order is accepted by us, we will provide you with an order confirmation and accordingly and advise you of the delivery status of your purchase. Until such order confirmation is provided we reserve the right to reject any offer to purchase our Products without giving you any reasons, including and without limitation in the following circumstances:


(a) where the order breaches these Terms;


(b) where there is an existing dispute between you and Starbucks;


(c) where there is total or partial non-payment of a previous order;


(d) to deal with technical problems on the Online Store, the Starbucks Website or Mobile App; or


(e) to update the Product to reflect changes in the relevant laws and/or regulatory requirements.


5.6. In the event that we are unable to accept your order (for example due to a payment issue), or if we are unable to fulfil your order for any reason (for example due to product unavailability or quality issues), we will notify you by phone or email of the order cancellation and process a refund of the relevant payments received (if any).


5.7. Subject to Clause 9 below, no order amendment, Product exchange, order or Product refund will be entertained after payment is made or an order confirmation is provided by us.


6. Payment Terms 


6.1. Our Online Store accepts payment via the following: MasterCard, Visa, Apply Pay, Google Pay, registered Starbucks Card (where applicable), or such other designated credit cards and electronic means as may be specified by us from time to time. Save for the purchase of a Starbucks Card eGift, you may purchase all Products on the Online Store using a Starbucks Card.


6.2. Starbucks has the right to modify the methods of payment available to you, at any time, being understood that the available methods of payment are those indicated on the Online Store at the time your order is placed. 


6.3. Acceptance of orders is subject to our sole discretion. A final receipt will be issued to you when goods are delivered to your address. Where there are additional charges for delivery, such charges will be set out separately for your acknowledgement and confirmation prior to proceeding to payment.


6.4. All Product prices and shipping fees listed are in Singapore dollars and are inclusive of GST at the applicable current rate chargeable in Singapore for the time being. The prices listed on our Online Store may differ from the prices of the same Products in our physical shops. For purchases made on the Online Store, the applicable price shall be the price listed in our Online Store as at the date of purchase.


6.5. Under credit card purchase protection services (e.g. Visa Verification Service, MasterCard Secure Code), customers can enjoy safe and secure shopping by using their own credit card with specific password or security code. Credit cards used for shopping should be valid and under the purchaser’s own name.


7. Supply of Goods


7.1. We only serve and deliver Products to end consumers. We do not sell our Products for resale purposes. By placing an order with us, you undertake and warrant that the purchase of any Product on the Online Store is not carried out in the course of your professional activity and is intended strictly for personal use. If we have grounds to believe that you are not purchasing our Products as an end user, we reserve the right to decline or cancel your order.


7.2. Title to the Products shall remain vested in us until and unless we receive full payment of the price of the Product, and all risk (including risk of loss, theft, or damage) shall pass to the customer upon delivery / collection of the Product (as the case may be).


7.3. We have the right to refuse to provide the Products to a customer if he/she violates the applicable laws and regulations or acts in a dishonest manner. The said action includes, without limitation, (a) using the Online Store by a customer to conduct illegal activities such as money laundering, theft of personal data, etc.; (b) disrupting the normal operation of the Online Store, improperly interfering with the normal operation of the Online Store, or acting in a manner that is deemed inappropriate by us; (c) providing fake or false information, or refusing to accept a delivery order without justifiable reasons, causing us being unable to deliver the Products or a severe delay in completing the delivery service, any of which action  might have occurred for more than once.


7.4. You agree to abide by all applicable laws and regulations and are solely responsible for your acts or omissions in connection with your use of our Online Store.


8. Shipping Services 


8.1. Shipping is available to addresses in Singapore except for Sentosa Island, Tuas Industrial areas, military camps/areas, protected areas, Jurong Island and other offshore islands.   


8.2. For successful orders placed at our Online Store and confirmed by us via email, the estimated time for shipping to your specified shipping address will be: 


(a) If express shipping is selected, by the next business day (except Sundays and public holidays) after your order has been confirmed, provided that your order is received before 3pm on a business day. 


(b) If standard shipping is selected, between 1 to 3 business days (except Sundays and public holidays) after your order has been confirmed. 


8.3. After your order has been accepted and confirmed, you will receive an order tracking number which you can use to track the shipping status of your order.


8.4. In case where the deliveries are delayed due to unforeseen circumstances, we or our delivery partners will contact you to reschedule the delivery.


8.5. In case of failed delivery, we will attempt to re-deliver your order again (up to 2 re-delivery attempts). If all 3 delivery attempts are unsuccessful, your order will be cancelled and refunded, but any shipping costs incurred for such delivery attempts will be borne by you. We shall not be responsible for any failed or incorrect deliveries resulting from your provision of inaccurate delivery information. 


8.6. All expected delivery dates are estimates only. We shall not be liable for any loss or damage incurred or suffered by the customer as a result of any late delivery.


8.7. In case of any dispute, our determination shall be final.


9. Returns and refunds


9.1. You are entitled to request to return and receive a refund for Products which have been delivered to you in certain circumstances. Please refer to the Starbucks Online Store Return Policy for more information on the terms, conditions and policies that apply to the return of any Product purchased on the Online Store.


10. Copyright and Trademark


10.1. Unless otherwise noted, all materials, including but not limited to all images, text, illustrations, designs, icons, photographs, programs, music clips, downloads, systems, video clips, graphics, user interfaces, visual interfaces, information, data, tools, products, written materials, services, design, structure, selection, coordination, expression content, information, design, marks and layout therein (the “Online Store Content”), as well as the look and feel and the design of the Online Store and the organisation of the Online Store Content are protected as the copyrights, trade dress, trademarks and/or other intellectual properties and all rights, title, and interest to all such Online Store Content is owned by Starbucks and/or its subsidiaries and affiliates or by other parties that have licensed their materials to Starbucks. All rights not expressly granted are reserved.


10.2. Subject to your compliance with these Terms, Starbucks grants you a limited, revocable, non-sublicensable and non-transferrable license to access and use the Online Store and the Online Store Content contained therein for personal, informational and non-commercial use. You hereby acknowledge and agree you will not reproduce, distribute, publish, transmit, modify, display or create derivative works from or exploit the contents of this site in any way. You agree to indemnify, defend and hold harmless Starbucks for any and all unauthorised uses you may make of any Online Store Content. You acknowledge and agree that the unauthorised use of the Online Store Content could cause irreparable harm to Starbucks and that in the event of an unauthorised use, we shall be entitled to an injunction in addition to any other remedies available at law or in equity. Nothing contained on the Online Store or in these Terms shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use the Online Store Content in any manner that is inconsistent with this Clause 10.2. All rights not expressly granted to you in these Terms are expressly reserved.


10.3. Some links on our Online Store will allow you to connect with sites that are not under our control. We are providing these links only as a convenience. The inclusion of such links does not imply Starbucks’ endorsement, and Starbucks will not be responsible for the contents of any such sites. You access them at your own risk.


11. Personal Data


11.1. You acknowledge and agree that in order to process and follow up your orders and payments and for other related purposes notified to you, we will collect, use, and/or disclose your personal data voluntarily submitted by you. The personal data includes, without limitation, your name, phone number, delivery address, and date of your purchase etc. 


11.2. In addition, in order to deliver the Products to you or the recipient designated by you, we will share with third-party partners personal data relating to you and the recipient designated by you, including your name, phone number, delivery address, the Product name, price and date of the purchase, etc.


11.3. If you place an order for other people, Starbucks will use, collect and process the information of the recipient designated by you, including but not limited to his/her name, delivery address and phone number. In doing so, you represent, undertake and warrant to us that:


(a) you have obtained consent from the designated recipient prior to your provision of their personal data to us;


(b) the designated recipient has agreed to share such personal data with the third-party partners by us for the purpose of processing the order; 


(c) you are validly acting on behalf of such individuals and that you have the authority to provide their personal data to Starbucks for the purpose of placing and processing the order; and 


(d) the personal data provided by you is accurate.


11.4. Please read the Privacy Policy carefully to understand how Starbucks collects, uses and discloses information about its customers.



12. Indemnification


12.1. At Starbucks’s request, you agree to defend, indemnify, and hold harmless Starbucks, Starbucks Corporation and their affiliated companies, independent contractors, service providers and consultants and their respective employees, contractors, agents, officers, directors, representatives, and/or advisers fully from and against any and all claims, suits, losses, damages, costs, lawsuits, fines, penalties, liabilities, and/or expenses (direct and/or indirect, and including legal fees and expenses on a full indemnity basis) that arise from or relate to the your access, use or misuse of Online Store, violation of these Terms or violation of any rights of a third party. Starbucks reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate in asserting any available defenses.


13. Warranties; Disclaimers


13.1. STARBUCKS IS PROVIDING THE ONLINE STORE TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND YOU ARE USING THE ONLINE STORE AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, STARBUCKS DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW, TRADE USAGE, OR OTHERWISE, INCLUDING ANY WARRANTIES THAT THE PRODUCTS ARE MERCHANTABLE, RELIABLE, AVAILABLE, ACCURATE, FIT FOR A PARTICULAR PURPOSE OR NEED OR SATISFACTORY QUALITY, NON-INFRINGING OR FREE OF DEFECTS OR VIRUSES OR ABLE TO OPERATE ON AN UNINTERRUPTED BASIS, OR THAT THE USE OF THE ONLINE STORE BY YOU ARE IN COMPLIANCE WITH LAWS APPLICABLE TO YOU THAT YOUR INFORMATION TRANSMITTED IN CONNECTION WITH THE ONLINE STORE WILL BE SUCCESSFULLY, ACCURATELY OR SECURELY TRANSMITTED OR RECEIVED, THAT ORDER WILL BE AS PLACED OR READY AT THE SUGGESTED TIME,OR THAT ANY PARTICULAR ITEM ORDERED WILL BE AVAILABLE.


14. No Liability


14.1. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL STARBUCKS OR THEIR AFFILIATED COMPANIES (A) BE LIABLE TO YOU WITH RESPECT TO USE OF THE ONLINE STORE; AND (B) BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, LOST PROFITS, LOSS, THEFT OR CORRUPTION OF YOUR INFORMATION, THE INABILITY TO USE THE ONLINE STORE OR ANY OF ITS FEATURES OR DEVICE FAILURE OR MALFUNCTION. YOUR SOLE REMEDY IS TO CEASE USING THE ONLINE STORE. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT (BUT SUBJECT TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW) SHALL THE AGGREGATE LIABILITY OF STARBUCKS, STARBUCKS CORPORATION AND THEIR AFFILIATED COMPANIES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE ONLINE STORE,  EXCEED ANY COMPENSATION YOU PAY, IF ANY, TO STARBUCKS FOR ACCESS TO OR USE OF THE ONLINE STORE,  FOR A PARTICULAR ORDER GIVING RISE TO SUCH LIABILITY. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, NOTHING IN THESE TERMS SHALL EXCLUDE OR RESTRICT STARBUCKS, STARBUCKS CORPORATION AND THEIR AFFILIATED COMPANIES’ LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM THEIR NEGLIGENCE, FRAUD OR FRAUDULENT MISREPRESENTATION, OR ANY OTHER MATTER FOR WHICH WE ARE NOT PERMITTED BY LAW TO EXCLUDE OR ATTEMPT TO LIMIT,


14.2. In no event shall Starbucks be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature or causes beyond our reasonable control including, without limitation, internet failures, computer equipment failures, telecommunication equipment failures, electrical power failures, strikes, labour disputes, riot, protest, shortages of labour or materials, fires, floods, storms, explosions, epidemics or other natural disasters, acts of God or delays or non-performance by third parties (“Events Outside Our Control”).


14.3. Where such Events Outside Our control occurs, any obligations we may have to you will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.


15. Amendments to the Online Store Terms of Service


15.1. Starbucks encourages you to regularly check these Terms, learn about the latest version, and consider whether or not to continue to use the Online Store.


15.2. Starbucks has the right to revise these Terms from time to time without notice to you. Such changes are effective once it is published on the Starbucks Website. If you continue to use the Online Store on or after the effective date of any such amendment, it will be deemed that you accept these Terms as amended.


16. General Terms


16.1. Termination: Starbucks may, in its sole discretion, restrict, suspend or cancel your access to or use of the Online Store or any part thereof without any notice to you. You will have no right to compensation or other remedy for being unable to access the Online Store.


16.2. Governing Law and Dispute Resolution: These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation, shall be governed by the law of the Republic of Singapore, without regard to conflict of laws rules. You agree that the courts of the Republic of Singapore shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms or its subject matter or formation.


16.3. Waiver and Severability: Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.


16.4. Third Party Rights: these Terms are entered into between you and us. No other person shall have any rights to enforce any terms of these Terms in respect of your use and access of the Online Store, whether under the Contracts (Rights of Third Parties) Act or otherwise.
